I hereby WAIVE AND RELEASE, indemnify, hold harmless and forever discharge Three Moons Farm LLC and Equine Assisted Learning, LLC dba Courses with Horses and its agents, employees, officers, directors, volunteers, affiliates, successors and assignments, of and from any and all claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages and liabilities, of every kinds and nature, whether known or unknown, in law or equity that I ever had or may have, arising from or in any way related to my participation, or anyone accompanying me regardless of relationship, in any events or activities conducted by, on the premises of, or for the benefit of Three Moons Farm LLC and Equine Assisted Learning, LLC dba Courses with Horses provided that this waiver of liability does not apply to any acts of gross negligence, or intentional, willful or wanton misconduct.

I understand that the activities that I/my child will participate in and that I/my child will see are inherently dangerous and may cause serious or grievous injuries, including bodily injury, damage to personal property and/or death.  I/my child will be in direct contact with animals that include but are not limited to horses, chickens, dogs, cats, and goats.  I understand that, as with most animals, they may react in unpredictable ways to sounds, sudden movement, people, or other animals that could result in injury to people. On behalf of myself, my children, my heirs, assigns and next of kin, I waive all claims for damages, injuries and death sustained to me or property, that I may have against the aforementioned released to party to such activity.

By this waiver, I assume any risk, and take full responsibility and waive any claims of personal injury, or death, or damage to personal property with Three Moons Farm LLC and Equine Assisted Learning, LLC dba Courses with Horses, including but not limited to visiting the farm, observing or interacting with the animals, using the facility and its equipment in any manner, form or fashion, and practicing and/or engaging in other related activities including the initiation of prohibited contact with the animals on and off the premises and disobeying any regulations both posted and unposted.  It is a condition of entry that visitors observe all warning signs, do not venture over exhibit safety barriers, and do not enter off-limits areas. 

By signing this waiver, I also agree that Three Moons Farm LLC and Equine Assisted Learning, LLC dba Courses with Horses may take photos. I agree to use such photographs with or without my name for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and Web content.

This WAIVER AND RELEASE contains the entire agreement between the parties and supersedes any prior written or oral agreement between them concerning the subject matter of this WAIVER AND RELEASE.  The provisions of this WAIVER AND RELEASE may be waived, altered, amended or repealed, in whole or in part, only upon the prior written consent of all parties.  The provision of this WAIVER AND RELEASE will continue in full force and effect even after the termination of the activities conducted by, on the premise of, or for the benefit of Equine Assisted Learning, LLC, whether by written agreement, by operation of law, or otherwise.

I have read, understand, and fully agree to the terms of this WAIVER AND RELEASE.  I understand and confirm that by signing this WAIVER AND RELEASE FROM LIABILITY that I have given up considerable future legal rights.  I have signed this agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to me.  My signature is proof of my intention to execute a complete and unconditional WAIVER AND RELEASE FROM LIABILITY of all liability to the full extent of the law.  I am 18 years of age or older and mentally competent to enter into this waiver.

1. I am the legal owner of the participating dog(s), and I assume all risks, dangers, and responsibility for injuries to the participating dog(s). 

2. I understand and agree that the I am solely responsible for any harm while the my dog(s) is/are attending Three Moons Farm, LLC

3. To the best of my knowledge, my dog is in good health and has not been in contact with any communicable illness within the past 14 days prior to attending Three Moons Farm, LLC.

4. Dogs must be on a maximum 6-foot leash at all times when not in the fenced off-leash area.

5. Dogs are fully vaccinated or have a current titer test.

1. Distemper/Parvovirus vaccine (3 of 3 series for puppies)

2. Rabies

3. Bordetella

4. Leptospirosis vaccine (2 of 2 series)

5. OPTIONAL but suggested: Bordetella vaccine, Lyme vaccine, and/or Influenza vaccine (2 of 2 series)

6. Barking is natural for dogs.  However, excess barking or nuisance barking can lead to frustrated neighbors. I agree to stop my dog(s) repeatedly barking for prolonged periods.

7. I agree to wait for previous guests to exit before I enter the off-leash area.  And to depart timely to all the next guest to enter.

8. To the best of my ability, I will pick up my dog(s)’ waste.

9. I will return all the toys we used and pick up any trash we created.
